Anna Nicole Smith named now-dead son as heir

Anna Nicole Smith said in a 2001 will that her estate should go to a longtime companion to hold in trust for her son, who has died, according to a document released Friday.

Anna Nicole Smith said in a 2001 will thather estate should go to a longtime companion to hold in trust for her son, who has died, according to a document released Friday.

Thewill said the former Playboy Playmate's estate should be held in trust by Howard K. Stern for Daniel Smith, who died last year, three days after Smith gave birth to a daughter.

"I have intentionally omitted to provide for my spouse and other heirs, including future spouses and children and other descendants now living and those hereafter born or adopted," Smith said in the will.

The document did not say where Smith wanted to be buried, but named Stern as her executor.

The lawyer for Smith's estranged mother, Virgie Arthur, said the will wasn't filed in any court, so it is not valid.

Stern is one ofseveral men claiming to have fathered Smith's daughter, Dannielynn, who could inherit millions of dollars. Stern isnamed as the father on the girl's birth certificate.

Earlier on Friday, a judge approved the embalming of Smith's body as he tried to broker an agreementbetween Stern, Arthur and photographer Larry Birkhead about what to do with the body.

Birkhead hopes Smith's DNA will help prove he fathered Dannielynn, while Stern argues Smith should be buried next to her son in the Bahamas. Arthur wants Smith buried in her home state of Texas.

Smith died at a Florida hotel on Feb. 8. She was 39.
