Two men take stand at MacIntosh trial

Two men, who said Fenwick MacIntosh sexually abused them in the 1970s, testified today in Port Hawksbury Supreme Court.

The men said they were in their mid-teens when MacIntosh performed oral sex on them.

Both men describe two alleged incidents.

Monday was the start of MacIntosh's second trial on charges of gross indecency and indecent assault.

He was found guilty earlier this year of molesting two boys in their early teens.

Prosecutor Diane MacGrath said the issue in these cases is whether MacIntosh had sex with them against their will.

"The issue in this case is whether or not they consented," said MacGrath. "In terms of the types of activity it is no different than in any of the other cases. Once you've reached the age of 14 then it is a question of whether or not the activity was consensual."

The defense suggested the first complainant asked MacIntosh to have anal sex with him and when he refused, their consensual relationship ended. The witness strongly denied this suggestion.

During cross examination, the second man told the court he was having a very hard day and then broke down on the stand.

A third complainant is expected to take the stand on Tuesday.
