MacIntosh's final accuser testifies

The final complainant in the Ernest Fenwick MacIntosh sex abuse trial took the stand Tuesday, saying he was nine or 10 years old when he was allegedly molested.

The man, who cannot be named, testified in Nova Scotia Supreme Court in Port Hawkesbury. He said he met MacIntosh, 67, in the 1970s because he was a fan of the Strait Pirates junior B hockey team and MacIntosh was on the executive.

He said the former businessman invited him to a boarding house to meet some of the players. He said MacIntosh invited him to Mulgrave, Guysborough County,a few weeks later to see a speedboat.

On that occasion, he said they went into a building and MacIntosh gave him a drink of rum or gin. He said the man lay on a bed and invited the boy to join him.

When he did, MacIntosh put his hands down his pants and began to rub his penis, the man testified. The man said he became very upset and wanted to go home.

He said he threatened to walk or swim if MacIntosh did not take him.

He said MacIntosh drove him home.

The Crown's final witness was Marcie MacQuarrie, a former business associate of MacIntosh.

"All of these offences, alleged offences occurred a long time ago," saidprosecutor Alicia Kennedy."We're just trying to bring out as much information as we can that can confirm what it is that the complainants are alleging."

Lawyer questions memory

David Bright, the defence lawyer, questioned the complainant's ability to remember events from the 1970s, citing his subsequent problems with alcohol.

The trial heard from two other men Monday who said MacIntosh sexually abused them when they were in their mid-teens in the 1970s.

MacIntosh's trial for gross indecency and indecent assault started Monday.

MacIntosh was convicted in July of 13 counts of indecent assault and gross indecency in two separate complaints dating to the 1970s. He was sentenced to four years in prison but was given credit for his two years in jail awaiting trial, leaving him only two years less a day to serve.

He is appealing those convictions.

He was granted bail in October and has been serving house arrest at his apartment in Dartmouth. RCMP first received the complaints more than 15 years ago.

MacIntosh was arrested in April 2007 near New Delhi, India, where he worked as a telecommunications specialist for 13 years. He was extradited to Canada two months later.

MacIntosh's defence will now begin. His lawyer has not revealed whether MacIntosh will take the stand
