Bobby Zoe guilty of breaking into home, sexually assaulting woman

A repeat Yellowknife offender has been found guilty of breaking into an Old Town home last February and sexually assaulting a woman and stealing cash.

Judge questioned credibility of Zoe's testimony

A repeat Yellowknife offenderhas been found guilty of breaking into an Old Townhome last February and sexually assaulting a woman and stealing cash.

Bobby Zoe, originally from Gameti, N.W.T., was charged with two counts of breakingand entering andcommitting an offence and one count of failing to comply with a probation order.

The judge said he based his verdict on two key issues, credibility and identification.

A backpack belonging to Zoe was found in the Old Town apartment where the break-in, theft and sexual assault occurred.

But during the trial,Zoe maintained he had stashed the backpack, which was filled with all of his possessions and some alcohol, at a ball field earlier that night. Zoe said he planned to stop by a bar and didn't want to be carrying the liquor in.

But Zoe never went to a bar that night. A friend saidhe saw Zoe with the backpack at a party that night until 2 a.m. The break-in occurred later that morning.

A glove that tested positive for Zoe's DNA was also found at the scene.

Zoe saidhe left the glove in his backpack but the judge questioned why he would do that considering the temperaturedipped that night to -35 with the windchill.
