Disgraced cop Sean Kelly appeals jail sentence

A Corner Brook police officer who made an indecent phone call to a young woman before trying to pin the crime on another person, is appealing the jail term he was sentenced to last year.

Royal Newfoundland Constabulary Const.Sean Kelly appeared in Supreme Court in Corner Brook Monday, where a date was set for an appeal hearing in September.

Kelly was sentenced to 10 months in jail for convictions of mischief and placing an indecent phone call last year.

But his lawyer filed paperwork on an appeal shortly after the sentencing in April 2015, and he was released from custody.

Kelly was tried and convicted for making a lewd phone call to a woman in 2012. He later tried to put the blame on another man.

In a statement he gave to police, Kelly accounted for the phone call by falsely explaining that he had loaned his police-issued phone to a person he was purportedly grooming as a source.

Suspended without pay

He has been suspended without pay from the RNC until all court matter are complete.

Meanwhile, the province's Public Prosecutions is doing a second review of how the RNC namely Sgt. Tim Buckle handled the investigation of Kelly.

An Ontario Provincial Police investigation released in December found there were deficiencies in the handling the Buckle's involvement in the Kelly case but said there were no grounds for criminal charges to be laid.

Multiple investigations into the case were prompted afterJudge Wayne Gorman said the RNC's investigation into the complaints against Kelly should have been handled differently and possibly shouldnot have been investigated by the RNC at all.
