Court appearance for Philip Smith, Cortney Lake's ex-boyfriend, set over

The ex-boyfriend of Cortney Lake, who hadhis home searched last week and a truck seized from the property, had his provincial court appearance set over.

Philip Steven Smith, 25, was scheduled to appear in court in St. John's at 9:30 a.m. for charges including driving while disqualified and breaking court orders.

Smith did not appear, and the matter was set over to July 11.

Court documents show Smith pleaded guilty to a number of offences on June 7, the same day Lake was last seen.

One of those offences was an April 15 assault against Lake. He was convicted of that and received a suspended sentence.

He was also convicted of breaching a recognizance that prohibited him from contacting Cortney Lake or her mother, Lisa Lake. That offence occurred two days before his June 7 court appearance. Smith was sentenced to two days time served.

The Royal Newfoundland Constabulary searched Smith's Alice Drive home on June 27, removing a number of items and impounding a black GMC pickup truck.

Surveillance footage from June 7 shows Lake getting into a black GMC pickup truck, a description that matches the truck towed from Smith's home. However, police have not said if the trucks are the same.

As part of the homicide investigation in Lake's disappearance, police and Rovers Search and Rescue scoured Torbaymans Pond, off the Trans-Canada Highway outside St. John's, near the Irving, on Monday.
