Krystal Toole's election, plea for allegedly helping Marissa Shephard delayed

The case of a Moncton woman accused of assisting murder fugitive Marissa Shephard has been adjourned until Friday.

The case of a Moncton woman accused of assisting murder fugitive Marissa Shephard has been adjourned until Friday.

KrystalToole, 32,who is charged withbeing an accessory after the fact to the first-degree murderof BayleeWylie,was scheduled toelecther mode of trial and enter a plea in Moncton provincial court on Monday.

But defence lawyer Hazen Brien told Judge Troy Sweethe just received further video evidence and has not had an opportunity to review the material.

Brien requested the matter be set over until Friday at 1:30 p.m. He also suggested there might be an opportunity to resolve the matter.

Toole remains in custody.

She was arrested on March 1 in Monctonin the company of Shephard, 20, and Stephen Nagle, 22.

Shephard had eluded police for about 10 weeks when she was arrested on a Canada-wide arrest warrant for first-degree murder and arson in connection withthe death of Wylie, 18, of Moncton.

Wylie's body was found on Dec. 17 in a burned apartment unit he had been sharing with Shephard, according to his mother.

RCMPhavedescribed Wylie's death as violent.

Shephard was found fit to stand trial after a 30-day psychiatric exam and is scheduled to return to court on June 3.

Nagle, who was also charged withbeing an accessory after the fact to the first-degree murderofWylie, changed his plea to guilty on April 25.

He was sentenced to nine months in jail, less the time he has already served in custody since his arrest.He was also given oneyear of probation,ordered to have no contact with Shephard or Toole, and is prohibited from owning or possessing any firearms.

Tyler Noel, 18, is also charged with first-degree murder and arson in Wylie's death. His four-day preliminary hearing is scheduled to begin on May 16.

Devin Morningstar, 18, who is facing the same charges,waived his right to a preliminary hearing and is scheduled to stand trial on Oct. 18. Eight weeks have been set aside for his trial.
